Please read these Terms and Conditions (“Terms”, “Terms andConditions”) carefully before using the billing. skynats.com website (the”Service”) operated by Skynats Technologies (“us”,”we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may contact us.

You further acknowledge and agree that Skynats shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Kerala, India, without regard to its conflict of law provisions.Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of this Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision as material we will try to provide at least 15 days notice before any new terms taking effect. What constitutes a material change will be determined at our sole discretion. A small river named Duden flows by their place and supplies it with the necessary regelialia. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Services

Certain services carry a fee charged by Skynats Technologies to the client, which must be paid by client in order to have use of said services. If client terminates this agreement, the client shall be responsible for any and all outstanding fees owed to Skynats Technologies and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when the client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.

Billing

By the Account Activation Date of each month, Skynats Technologies shall deliver, by e-mail or regular mail, an invoice in accordance with the applicable service fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to Skynats Technologies by no later than the specified payment due date. Skynats Technologies shall be entitled to immediately terminate this agreement for client’s failure to make timely payments and revert the changes/fix/setup made in the server. You will be provided with an invoice on a monthly basis. All credit cards are billed automatically on a monthly basis. It is the client’s responsibility to ensure that they have sufficient credit to cover this transaction. If there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 24 hours. If we do not receive a response within 24 hours, the account, and all accounts under that account plan, will be suspended.

Limitation of Liability

Skynats Technologies shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from SkynatsTechnologies services going off-line or being unavailable for any reason whatsoever. Furthermore, Skynats Technologies shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website. All damages shall be limited to the immediate termination of service.

Indemnification

Customer agrees that it will protect, indemnify, save and hold Skynats Technologies harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable attorney’s fees assessed against Skynats Technologies, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it’s customers, agents, employees or assigns. Customer agrees to defend, indemnify and hold Skynats Technologies harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or distributed in association with Skynats Technologies Services; (2) Any material furnished by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) Copyright violation and any defective products sold to a customer Skynats Technologies Services.

One Time Services

No support will be given to these services, including troubleshooting any problems that occur caused by the services unless Skynats Technologies so chooses. SkynatsTechnologies reserves the right to refuse additional support. Once a ticket is deemed “closed” and payment has been made Skynats Technologies has the right to refuse any future service and/or support relating to the ticket.

Response Time and Resolution Time

While Skynats Technologies makes its best efforts to complete any submitted tickets as soon as possible, Skynats Technologies is not able to guarantee the resolution time of any ticket. However, response times are guaranteed to be within 12 hours of the time a ticket was submitted. Tickets submissions are only via the helpdesk and do not include any type of instant messenger support request. The customer also understands that a ticket in required for any action to occur; instant messaging is provided only as a courteous service.

This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. We use strong SSL encryption to ensure your privacy

Hosting Content

Skynats Technologies shall not be held responsible for any of the content/media/website/database/links hosted on the client server/webpage. Skynats Technologies shall have the full authority to withdraw from the contract or terminate the service/support/accounts of the client if any complaints/abusive/sexual-abuse/child-porn/human-trafficking contents are found on the sites/server managed by the Skynats Technologies. In case of such instance or termination, the client won’t be eligible for any refund of the amount paid to Skynats Technologies.

Customer Abuse

We have zero tolerance for abusive language and/or abusive behavior towards our company and/or service Skynats Technologies provide and/or our employees. Any customer deemed at our sole discretion to be abusive to our company and/or service we provide and/or our employees will result in immediate irrevocable account termination without any refund. Threats to sue, slander, libel, etc., are all considered forms of abuse and will result in immediate irrevocable account termination without any refund.

Disclaimer

Skynats Technologies cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Skynats Technologies are resold. Thus, certain equipment, routing, software and programming used by Skynats Technologies are not directly owned or written by Skynats Technologies. Moreover, Skynats Technologies holds no responsibility for the use of our clients’ accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Skynats Technologies sees fit.
